OVERTIME PAY CASES
|
Drivers: Patrick Chavez, et al., v. City of Albuquerque (U.S. District Court) - Class Action case (filed in 2002) for overtime wages owed to City employees due to alleged failure to properly calculate overtime pay due to: 1) failure to include longevity, differentials, etc. in "regular rate of pay;" 2) incorrect deductions for holiday, illness, and other leave time; and 3) incorrect calculation. More than 350 employees represented by attorneys Sam Bregman and Paul Livingston have "opted in" to the case.
Supervisors: Karch, et al., v. City of Albuquerque (U.S.District Court) - Class Action case (filed in 2005) by Management-Series (M-Series) employees for overtime wages due to misclassification of "non-exempt" employees as "exempt" and alleged failure to pay some "non-exempt" employees overtime wages. The Court has limited participation in this lawsuit to those who opted in prior to October 31, 2006
