Albuquerque
This case was filed in May, 2002, under the provisions of the Fair Labor Standards Act (FLSA), the law which provides federal minimum wages and guarantees non-exempt employees time and a half payment for overtime over 40 hours per week. In this case, the Plaintiffs claim they are entitled to overtime wages owed by City due to the City's failure to properly calculate overtime pay: 1) failure to include longevity, differentials, etc. in "regular rate of pay;" 2) incorrect deductions for holiday, illness, and other leave time; and 3) incorrect calculation. More than 350 employees represented by attorneys Sam Bregman and Paul Livingston have "opted in" to the case. The Court has approved a NOTICE OF COLLECTIVE ACTION to be sent to prospective members of the class. This will be done as soon as the City provides a complete list of eligible employees and former employees To be a Plaintiff in this lawsuit, a City employee or former-employee must sign a "consent form" which permits representation by one of the attorneys representing Plaintiffs in the lawsuit, either Sam Bregman or Paul Livingston.
